General Terms and Conditions for Zurich Airport Ltd. Online Products

1. General section

1.1. Scope

These General Terms and Conditions ("GTC") of Flughafen Zürich AG ("FZAG") apply to the use of the website, e-commerce platform, chat and messenger services, the parking and ZRH Comfort booking system (hereinafter referred to as "online platform") and the services and products offered by FZAG (hereinafter referred to as "online products") as well as to all bookings made and contracts concluded via these (hereinafter referred to as "booking"). Any terms and conditions of the customer that contradict or deviate from these GTC will not be recognised, unless FZAG has expressly agreed to their validity in writing. 

The current and binding version of the GTC is published on the FZAG website. The version of the GTC applicable at the time of booking shall apply, which cannot be unilaterally amended for this booking. These GTC may be amended by FZAG at any time and without prior notice.

1.2. Offer and conclusion of the contract

All online products and prices published on the online platform of FZAG are deemed to be an offer of FZAG. The offer is valid as long as it is visible on the online platform and/or stocks last. Prices and products are subject to change at any time.

By sending the booking to FZAG, the customer accepts the offer. As soon as FZAG confirms the booking and its details by e-mail, the contract is concluded with the confirmed content. FZAG is free to refuse bookings in whole or in part without stating reasons. In this case, the customer will be informed and any payments already made will be refunded. Further claims by the customer are excluded.

FZAG is authorised to provide services from travel options through third parties.

1.3. Mediation by third-party providers

These GTC also apply to all bookings made through third-party providers. The brokerage of online products by third-party providers (including platforms) is only permitted with corresponding contracts with FZAG. The brokerage of online products by third-party providers without a contractual basis with FZAG is not permitted and corresponding bookings are invalid and will be cancelled. Authorised third-party providers can advertise online products in their own name via their own channels. The customer will be redirected to FZAG's online platform if they are interested. The booking by the customer must in any case be made on the FZAG online platform. The contract for online products is concluded directly between the customer and FZAG. The direct sale of online products by third-party providers is not permitted. FZAG accepts no liability for misleading, incomplete or incorrect information on online products provided by the third-party provider.

1.4. Price

Prices are quoted in Swiss francs, including value added tax (VAT).

FZAG reserves the right to change the prices of online products at any time. The price on the online platform at the time of booking is decisive. Promotional prices are valid for bookings made during the advertised promotional period and/or while stocks last.  

1.5. FZAG's liability 

FZAG's liability is excluded to the extent permitted by law. In particular, any liability of FZAG for personal injury and/or damage to the vehicle or other property of the customer or owner of a booking shall be excluded to the extent permitted by law.

FZAG is not liable for the services of third parties who provide services from travel options (e.g. lounge use, catering, parking damage insurance) as auxiliary persons. FZAG shall assign the claims to which it is entitled against the third party to the customer.

1.6. Promotions

The discounts are based on the usual parking and product tariffs (excluding taxes and other charges) as published on the FZAG website. The promotion may be terminated prematurely at any time without prior notice or subject to additional restrictions. Only one promotion code can be redeemed per booking. The discount can only be redeemed via the online platform and is only valid for FZAG online products. The corresponding value of the discount can neither be paid out nor credited in any other way. The promotion code is transferable.

1.7. Extraordinary termination

In the event of illegal or non-contractual behaviour on the part of the customer, FZAG shall be entitled to terminate all contracts with the customer without notice and without compensation and to discontinue the provision of services. FZAG reserves the right to claim damages.

1.8. Data protection

FZAG's privacy policy, available at www.flughafen-zuerich.ch/data-protection-declaration, applies to the processing of personal data by FZAG.

1.9. Applicable law and place of jurisdiction

The GTC and the contractual relationship existing between FZAG and the customer or holder of a booking shall be governed exclusively by substantive Swiss law to the exclusion of conflict of law provisions and the provisions of the UN Convention on Contracts for the International Sale of Goods. The exclusive place of jurisdiction is the registered office of FZAG.

1.10. Partial invalidity

Should individual provisions of the GTC and/or the booking be incomplete, legally invalid or unenforceable for legal reasons, this shall not affect the validity of the remaining provisions of the GTC and/or the booking. In such a case, FZAG and the customer shall reach an agreement that replaces the provision in question with an effective provision that is as economically equivalent as possible. 

2. Parking Products

2.1. Content of the contract 

Upon conclusion of the contract (booking) the customer acquires the right to park his vehicle for the period agreed in the booking and in the parking facility defined in the booking (multi-storey car park or car park, hereinafter referred to as "parking facility"). There is no entitlement to a specific parking space. It is possible to book a parking product up to one hour before the planned start of parking.

The prices displayed at the time of booking are only valid if booked in advance via the FZAG car park booking system and apply exclusively for the period booked. Multiple entries and exits with the same booking are not possible. The cost of the parking product (parking tariff) at Zurich Airport depends on the location, duration and time of booking.

2.2. Terms of payment

The car park rate is due and payable immediately at the time of booking using the payment methods indicated in the payment process. The amount will be shown on the customer's invoice under the reference "PARKING-RESERVATION, ZURICH".

2.3. Parking duration

If the customer exceeds the contractually agreed parking time, the additional time until the customer exits the car park will be charged based on the applicable rates. If the customer leaves the car park before the end of the contractually agreed parking time, he will not be entitled to claim reimbursement of or credit for the charge for the time not used.

FZAG is required to make the car park available 3 hours before the agreed entry time and up to 3 hours after the booked exit time. If the customer wishes to enter the car park earlier than 3 hours before the contractually agreed time, FZAG may refuse entry.

FZAG is entitled to remove the vehicle from the car park or have it removed at the customer's expense and risk once the agreed parking period has expired if the customer has not left the car park within 24 hours of the agreed exit time.

2.4. Rebookings / Cancellations / extend stay

Rebookings are only possible up to the booked entry time. There is no rebooking fee, but prices are subject to change due to dynamic pricing. In the event of a rebooking, the customer will receive a new booking confirmation.

Free cancellations after booking completion are only possible with the booked cancellation protection. If no cancellation protection has been booked, free cancellation is not possible. The customer can see the cancellation conditions in the product overview and in the booking confirmation.

It is not possible to shorten the parking time after entering the car park. Parking time extensions after entry are possible up to the originally booked exit time. Price changes are possible due to the extended parking duration and dynamic pricing. If the parking period is extended after entry, the customer will receive a confirmation with the same booking number.

There will be no refund of the paid tariff or credit for the unused parking time if the customer does not fulfil their booking/reservation. 

FZAG may demand an expense allowance from the customer for refunds.

2.5. Rules for use

The FZAG parking regulations apply to the use of the car parks and parking spaces.

3. ZRH Comfort products

3.1. Content of the contract

Upon conclusion of the contract (booking), the customer acquires the right to use the booked ZRH Comfort product to the contractually agreed extent for the specified persons during the period of use.

ZRH Comfort products can only be used by customers who have a valid boarding pass for the booked date.

The price and extent of the ZRH Comfort product is determined by the description on the FZAG website.

3.2. Terms of payment

The product rate is due and payable immediately upon booking using the means of payment specified in the payment process. The amount will be shown on the customer's invoice under the reference "ZRH Comfort". Booking a ZRH Comfort product is possible at the earliest 90 calendar days before the desired departure date.

3.3. Duration of use

The customer is entitled to use the ZRH Comfort product on the booked date until the time of departure.

3.4. Rebookings / Cancellations

The name of the passengers for ZRH Comfort bookings provided must match the information in the passport.

Name changes for existing ZRH Comfort bookings can be made free of charge via the online platform up to two hours before the scheduled departure time. A booked ZRH Comfort product can be transferred to another person by changing their name, provided this person has a valid boarding pass for the same flight. A registered profile is required for changes, which is the same e-mail address as the e-mail address that was specified as the contact during the original booking. If you ordered as a guest, you must subsequently create a profile with the same e-mail address as the original booking.

Free (partial) cancellations of ZRH Comfort bookings are only possible up to 24 hours before the scheduled departure time. Less than 24 hours before the scheduled departure time, the ZRH Comfort product can only be cancelled free of charge if the flight has been cancelled and the product has not yet been used by the customer. In the event of cancellation, the product rate will be credited to the customer's means of payment. The customer can see the cancellation conditions in the product overview and in the booking confirmation.

Rebookings (e.g. change of travel dates) are not possible. However, the ZRH Comfort product can be cancelled free of charge at least 24 hours before the originally scheduled departure time and booked for a new travel date.

3.5. Rules for use

The general site regulations of FZAG apply.
